Under Section 21 of the Criminal Code (R.S.C., 1985, c. C-46), a person is a party to an offence if they aid or abet another person in committing it. [1]

What is Aiding?

Section 21(1)(b) covers aiding.
Aiding means helping or assisting the main offender in any way.
It includes physical actions or deliberate omissions (failing to act) intended to help.
The helper must know the crime is planned. [1, 2, 3]

What is Abetting?

Section 21(1)(c) covers abetting.
Abetting means encouraging, instigating, or promoting a crime while it takes place.
Spoken words or gestures of support during the crime can be enough.
The person must intend to encourage the main offender. [1, 2]

Legal Penalties

Aiders and abettors share equal criminal culpability with the main offender.
They face the same charges and potential punishments as the primary actor. [1]
